Zawiadomienie o przestępstwie

Notice of the offense

Niniejszym zawiadamiam o dokonaniu na moją szkodę przestępstwa znieważenia, zniesławienia oraz pomówienia. Wnoszę o wszczęcie i przeprowadzenie w niniejszej sprawie postępowania karnego, w szczególności o zbadanie „dowodu dedukcyjnego” opisanego w załącznikach.

I hereby give notice of the crime of insult, defamation and slander committed to my detriment. I request that criminal proceedings be instituted and conducted in the present case, in particular for the examination of the „deductive evidence” described in the annexes.

Uzasadnienie   Justification

Przez kilka lat, począwszy od 2009, poczytna pisarka Magdalena Chomuszko twierdziła, i do dzisiaj tak uważa, że na portalu NaszaKlasa założyłem drugie konto na dane niejakiego Jacka Kawalca, z którego to konta (pod tymi cudzymi danymi) nikczemnie ją obrażałem, co spowodowało, iż pisarka doznała emocjonalnego wstrząsu (nawet była leczona, kiedy próbowałem jej wyjaśnić przez lata, że to jednak pomyłka), który w znacznym stopniu ograniczył jej możliwości logicznego myślenia.

For several years, starting from 2009, the widely read writer Magdalena Chomuszko claimed, and to this day, she thinks so that on the NaszaKlasa portal I set up a second account with the name of a certain Jacek Kawalec, from which I insulted her (under his data), which resulted in that the writer had suffered an emotional shock (she had even been treated after I tried to explain to her for years that it was a mistake after all) that greatly limited her ability to think logically.

Nie byłoby w tym nic wyjątkowego, gdyby nie to, że znalazła poparcie u swoich zwolenników, w rodzaju p. Dominika Langnera (ten obywatel żądał 50 tys. zł za zniesławienie), którzy utwierdzili ją w fałszywym przekonaniu, że byłem J. Kawalcem i poparli załączony „dedukcyjny dowód” (tak go naukowo, jak przystało na wolno myślicieli, nazwali).

There would be nothing exceptional about it, if it were not for the fact that she found support from her supporters, such as Mr. Dominik Langner (this citizen demanded 50,000 zlotys for defamation), who confirmed her false belief that I was J. Kawalec and supported the attached „deductive proof” (as it is scientifically the slow thinkers, they called it).

Dowód uznano za wiarygodny, zatem pisarka rozpętała dwa procesy w gdańskich sądach – w trybie cywilnym i karnym, żądając przeprosin i 20 tys. zł (nawet w przypadku przeproszenia!).

The evidence was considered credible, so the writer launched two trials in Gdańsk courts – in civil and criminal proceedings, demanding an apology and 20,000. zł (even in the event of an apology!).

Pierwszy proces IC692/09 pisarka wygrała, bowiem nie byłem ani razu w sądzie (zawał, leczenie, brak informacji o wydanym wyroku, zatem oczywiste przeoczenie terminu apelacji), ale drugi, karny, przegrała i ten wyrok całkowicie podważa wartość pierwszego wyroku wydanego przez sędziego (Wojciech Midziak), który po prostu skompromitował się jako Polak nierozumiejący polskich słów i jako kiepsko widzący – nie dostrzegł dowodów na moją korzyść.

The writer won the first trial IC692/09, because I had not been to court even once (heart attack, treatment, no information about the sentence passed, therefore an obvious omission of the appeal date), but the second, criminal, lost and this sentence completely undermines the value of the first sentence issued by the judge (Wojciech Midziak), who simply discredited himself as a Pole who did not understand Polish words and as poor eyesight – did not see any evidence in my favor.

Krótko pisząc – drugi wyrok wydany na podstawie opinii językowej biegłego sądowego rozsmarował pisarkę i sędziego oraz adwokata (Karol Kolankiewicz), który nie tylko dał się wciągnąć w owe procesy, ale pozwolił sobie na fałszerstwa w tekstach zarzutów składanych przed sądami.

Briefly writing – the second verdict, issued on the basis of the linguistic opinion of a court expert, demolished the writer, judge and attorney (Karol Kolankiewicz), who not only got involved in these trials, but allowed himself to forge the texts of the charges brought to the courts.

Niestety, po latach sprawa odżyła, bowiem białogardzki skrablista, Władysław Stanisław Zieliński, przez dwa miesiące pozwalał sobie na odważne (bo pod nikami Labans oraz – na sjp.pl – Balans) zamieszczanie obrzydliwych komentarzy (ok. 300!) na mój temat na portalu salon24.pl, rozpowszechniając nieprawdę, że posiadałem konto na dane Jacka Kawalca.

Unfortunately, after many years the case was revived, because Władysław Stanisław Zieliński, a scrabble player from Białogard, for two months allowed himself to boldly (under the nicknames Labans and – on sjp.pl – Balans) post disgusting comments (about 300!) About me on the portal salon24.pl, spreading the untruth that I had an account on data Jacek Kawalec.

Po ujawnieniu w internecie jego prawdziwych danych i po skopiowaniu jego rynsztokowych tekstów oraz po przekazaniu jego sprawy w styczniu 2022 do Prokuratury Rejonowej w Gdyni, ów waleczny zwolennik pisarki nagle… zaprzestał wszelkich publikacji, choć – jeszcze jako anonim – odgrażał się, że będzie mnie nękać latami. Ileż to kultura polska straciła po rezygnacji tego pana z uczestnictwa w dyskusyjnych forach…

After disclosing his real data on the Internet and copying his gutter texts, and after his case was transferred to the Regional Prosecutor’s Office in Gdynia in January 2022, this brave supporter of the writer suddenly… stopped all publications, although – still as an anonymous – he threatened to harass me for years. How much Polish culture has lost after this gentleman resigned from participation in discussion forums…

Kolejnym uczestnikiem wieloletniej batalii o uznanie mnie za J. Kawalca jest… syn pisarki, p. Jan Chomuszko. Przez lata pisywał niegodziwe komentarze na mój temat, twierdząc, że miałem drugie konto, z którego postponowałem jego mamę. Pisywał odważnie jako p..p i dopiero w styczniu 2022 (zatem to dla mnie całkowicie nowa informacja) przypadkowo odkryłem, że to… syn znakomitej pisarki.

Another participant in the long-term battle to be recognized as J. Kawalec is… the writer’s son, Mr. Jan Chomuszko. Over the years, he wrote wicked comments about me, claiming that I had a second account from which I wrote to his mom. He wrote boldly as p..p and only in January 2022 (so this is completely new information for me) I accidentally discovered that he was… the son of an excellent writer.

Poza nimi wpisywało się kilku pseudointeligentów, którzy uparcie obrażali mnie podobnymi komentarzami (gdyby staranniej się przyjrzeć, to można by dostrzec podobieństwa do stylu pisania omawianej rodziny), ale pewnie Temidzie nie uda się ich zlokalizować, a są na tyle tchórzliwi, że nie będą dzisiaj otwarcie walczyć pod swymi nazwiskami o honor pisarki.

Apart from them, there were a few pseudointeligants who stubbornly insulted me with similar comments (if you look closely, you could see similarities to the writing style of the family in question), but probably Themis will not be able to locate them, and they are so cowardly that they will not be today openly fight under their names for the honor of the writer.

Trudno pojąć, dlaczego tacy zdolni ludzie, po maturze i po studiach, niejako kwiat polskiej inteligencji, grupowo popadli w zdumiewająco koszmarny psychiczny stan uniemożliwiający właściwą ocenę posiadania dwóch kont (a nawet trzech, bowiem pisarka wcześniej wycofała się z dodatkowego oskarżenia) – wzięta a stateczna pisarka M. Chomuszko, jej syn Jan, oficer marynarki handlowej (kariera przed nim), zdolny dyrektor Dominik Langner – co im przyszło do łbów, aby przez lata twierdzić, że pisałem jako Kawalec i dowodzić racji, których nie mają?! To właściwie jest problem z zakresu psychiatrii. A to, że za sobą pociągnęli adwokata i sędziego, to już prawdziwe wisienki na błazeńskim torcie.

It is difficult to understand why such talented people, after matura and studies, the outstanding flower of the Polish intelligentsia, fell into an astonishingly nightmarish mental state as a team, making it impossible to properly assess the possession of two accounts (or even three, because the writer had earlier withdrawn from the additional accusation) – taken and sedate writer M. Chomuszko, her son Jan, merchant navy officer (career before him), talented director Dominik Langner – what went into their nobs for years to claim that I wrote as Kawalec and prove their reasons, which they do not have?! This is actually a psychiatric problem. And that’s that they dragged a attorney and a judge with them, these are real cherries on a jester’s cake.

Pozostaje kwestia zbadania „dedukcyjnego dowodu”, którym ci znakomici obywatele przez lata dowodzili, że byłem J. Kawalcem. Należy dogłębnie ocenić racje obu stron i wydać opinię na ten temat, o co wnoszę, zwłaszcza że również p. M. Chomuszko parokrotnie zgłaszała ten wniosek do sądu.

There remains the question of examining the „deductive proof” by which these distinguished citizens have proved for years that I was J. Kawalec. The arguments of both parties should be thoroughly assessed and an opinion should be given on this, which I am asking for, especially since Mrs. M. Chomuszko has also submitted this motion to the court several times.

At the same time, I propose a text of an apology that they should post in the media –

My, Magdalena Chomuszko oraz Jan Chomuszko, przepraszamy Pana Mirosława Nalezińskiego za wieloletnie zniesławianie w internecie słowami powszechnie uznanymi za obraźliwe oraz przepraszamy za pomówienie polegające na twierdzeniu, że Pan Naleziński w 2009 roku na portalu NaszaKlasa założył dodatkowe konto (na nazwisko Jacek Kawalec), co nie jest prawdą (nie ma ŻADNYCH dowodów na poparcie tej tezy, poza naszym ułomnym „dedukcyjny dowodem”).

We, Magdalena Chomuszko and Jan Chomuszko, apologize to Mr. Mirosław Naleziński for many years of defamation on the internet with words commonly considered offensive, and we apologize for the libel consisting in the claim that Mr. Naleziński created an additional account on the NaszaKlasa portal in 2009 (in the name of Jacek Kawalec), which it is not true (there is NO evidence to support this, other than our flawed „deductive proof”). 

Owe opisane czyny uznajemy za niegodne naszej pozycji społecznej.

We consider these deeds to be unworthy of our social position. 

Jednocześnie wnosimy o unieważnienie lub powtórzenie procesu IC692/09, bowiem został wytoczony na podstawie błędnej naszej oceny, zaś w kwestii zniesławienia mnie, jako pisarki, w osądzanych artykułach autorstwa Pana M. Nalezińskiego, proces karny wykazał, że nie doszło do przestępstwa, a to oznacza, że nie będziemy administratorom przedstawiać ww. wyroku, aby kasowali felietony autora.

At the same time, we are requesting the annulment or repetition of the IC692/09 trial, because it was brought on the basis of our incorrect assessment, and in the matter of defamation of me as a writer, in the judged articles by Mr. M. Naleziński, the criminal trial showed that there was no crime, and this means that we will not present the administrators with the above-mentioned of the verdict to delete the author’s feuilletons. 

Oświadczamy, że ubolewamy z powodu wyrządzonej krzywdy Panu Mirosławowi Nalezińskiemu.

We declare that we regret due to the harm done to Mr. Mirosław Naleziński. 

Powyższy tekst powinien być sporządzony na arkuszu A4, czytelnie podpisany przez ww. obywateli oraz uwiarygodniony pieczęcią Prokuratury.

The above text should be made on an A4 sheet, legibly signed by the above-mentioned citizens and authenticated with the seal of the Prosecutor’s Office.

W przypadku przedsądowego porozumienia proponuję solidarne zadośćuczynienie w wys. 5000 zł, zaś w przypadku oddania sprawy do sądu – 20 000 zł, czyli tyle, ile p. M. Chomuszko żądała w 2009 roku.

In the case of a pre-trial agreement, I propose joint and several compensation in the amount of PLN 5,000, and in the case of bringing the case to court – PLN 20,000, which is as much as Mrs. M. Chomuszko demanded in 2009.
