The portal Pardon published a very interesting information about a blonde having sex with a teenager boy (with the use of attractive phrases – „The court had no mercy” and „sometimes you have to pay dearly for a fun life”), which it presented in a very funny way:

 

„Susan Divers z Leicester ma 25 lat i dwoje dzieci, ale bynajmniej nie należy do typu spokojnej mamuśki. Na stronie randkowej określała się jako ‘niegrzeczna dziewczynka’ oraz umieszczała swoje zdjęcia w prowokacyjnych (a właściwie po prostu dziwkarskich) strojach i pozach. Chwaliła się też, że potrafi zarzucić sobie nogi na kark – taka jest wygimnastykowana”.

Susan Divers from Leicester is 25 years old and has two children, but she is by no means the quiet mom type. On the dating site, she described herself as a 'naughty girl” and put her photos in provocative (or actually just slutty) outfits and poses. She also boasted that she could throw her legs over her neck – that’s how flexible she is”.

 

Okazuje się, że pani dobrowolnie zamieszczała swoje wypowiedzi i fotki, prowokując los i niedobrych policjantów, sędziów oraz dziennikarzy (w tym – jak widać – polskich), którzy sobie dość frywolnie używają po jej danych osobowych i po wizerunku (u nas to nie do pomyślenia). Pomógł im adorator owej pani, który przyłapał ją w ich narzeczeńskim łożu z… 14-latkiem i poinformował brytyjskie organa (a według innych – doniósł im). Rozrywkowa pani została skazana na 3 lata więzienia a ponadto trafiła (dożywotnio) na listę przestępców seksualnych.

It turns out that the lady of her own free will posted her statements and photos, provoking fate and bad policemen, judges and journalists (including – as you can see – Polish ones), who quite frivolously use her personal data and image (in Poland it is unthinkable). They were helped by the admirer of the lady, who caught her in their fiancé bed with… a 14-year-old boy and informed the British authorities (and according to others – he denunciated them). The cheerful lady was sentenced to 3 years in prison and, moreover, was placed (for life) on the list of sex offenders.

 

U nas inna pani (i to… doktorantka Uniwersytetu Gdańskiego) zamieszczała swoje frywolne dowcipy pośród innych, znacznie wulgarniejszych. Do tego wielokrotnie kłamała (i bez żenady rozpowszechniała to zniesławienie), że pewien gość ma dodatkowe konta, z których ją obraża. Ponieważ była aż tak pewna swych dedukcyjnych dowodów, pozwoliła sobie nawet na sfałszowanie podpisu w komentarzu zawierającym cytat (jedno nazwisko generowane automatycznie przez program podczas cytowania, z klawiatury, z pełna premedytacją zamieniła na inne nazwisko).

Here, in Poland, another lady (and a doctoral student at the University of Gdańsk) posted her frivolous jokes among others, much more vulgar. In addition, she repeatedly lied (and spread the defamation without embarrassment) that a certain guy had additional accounts that offended her. Because she was so sure of her deductive evidence, she even allowed herself to forge the signature in the comment containing the quote (one surname generated automatically by the program during quotation, from the keyboard, she deliberately changed it for another name).

 

Kiedy na innych internetowych portalach ujawniono jej wyczyny, poczuła się wielce pokrzywdzona, zlikwidowała swoje konto na sławnym portalu i udała się ze swoim prawnikiem do Policji oraz do dwóch gdańskich sądów. Pierwszy sąd (sprawa cywilna IC692/09) w wyroku z 18 grudnia 2009 nakazał przeprosić pisarkę za zamieszczenie tekstów sugerujących jej niewłaściwe zachowanie się wobec pozwanego, bowiem sędzia uznał, że nieprawdą jest, jakoby doktorantka UG „zachowywała się niegodnie, nieuprzejmie, obelżywie, bądź wulgarnie”.

When her actions were disclosed on other internet portals, she felt greatly aggrieved, canceled her account on the famous portal and went with her lawyer to the Police and to two courts in Gdańsk. The first court (civil case IC692/09), in its verdict of 18 December 2009, ordered the defendant to apologize to the writer for posting texts suggesting her inappropriate behavior towards the defendant, because the judge found that it was not true that the doctoral student „behaved unkindly, rude, insultingly or vulgar”.

 

No to rzućmy okiem na wypowiedzi tej dobrze ułożonej i eleganckiej pani (autorki książek z dziedziny komputerowej księgowości). Jeśli ktoś chce, to może dla każdej wypowiedzi punktować uprzejmość tej pani w skali ocen szkolnych lub uniwersyteckich i obliczyć średnią ocenę dla całego zbioru, bowiem w styczniu 2009, na portalu NaszaKlasa, ta utalentowana trójmiejska pisarka zamieściła następujące – jakże kulturalne – teksty:

Well, let’s take a look at the statements of this well–mannered and elegant lady (author of books on computer accounting). If someone wants, he or she can score this lady’s courtesy on the school or university grading scale for each statement and calculate the average grade for the entire collection, because in January 2009, on the NaszaKlasa website, this talented Tricity writer posted the following – how glamorous – texts:

 

– „Ilość Pana wypowiedzi na forum jest wystarczającym materiałem do wyrobienia sobie zdania na temat Pana.. oraz świetnym materiałem badawczym dla psychiatry”;

– „The number of your comments on the forum is sufficient material to form an opinion about you.. and a great research material for a psychiatrist”;

 

– „Proszę również zauważyć, że było tu miło dopóki nie pojawiły się 'mądrości’ pana MN..”;

– „Please also note that it was nice here until the 'wisdoms’ of Mr. MN came out..”;

 

– „Jakim prawem ocenia mnie jako matkę .. to jest po prostu chamstwo..” [potem, na Policji, przyznała, że pomyliła się – błędnie sądziła, że komentarz skierowany jest do niej];

– „By what right he judges me as a mother .. this is just rudeness..” [then, in the Police, she admitted that she had made a mistake – she erroneously concluded that the comment was directed at her];

 

– „Trzeba być wyjątkowym pieniaczem (czy czepiaczem – jak kto woli) , aby w ofercie banku 'kredyt dla nauczycieli’ doszukiwać się dyskryminacji. Absolwenci PG powinni mieć ścisłe umysły, a te z reguły znajdują najkrótszą drogę do trafnych wniosków :)”;

– „You have to be an exceptional arrogant (or a brawler – if someone prefers) to seek discrimination in the bank’s offer of 'loan for teachers’. Graduates of polytechnics should have strict minds, and these usually find the shortest path to accurate conclusions :)”;

 

– „A to ohydny donosiciel! ale to jest do niego podobne”;

– „And that’s a hideous denouncer! but it’s similar to him”;

– „Nie wiem jak inni, ale ja sobie serdecznie nie życzę, aby pan MN wypowiadał się w moim imieniu, a już na pewno nie podpisuję się pod żadnym jego tekstem”;

– „I do not know about the others, but I sincerely do not wish Mr. MN to speak on my behalf, and certainly I do not sign under any of his texts”;

 

– „No właśnie powiedziałam, że Krzysztof ma rację, sprawę zamknąć.. a ja dodam zamknąć, zawiązać, obciążyć kamieniami, wrzucić do morza (jak grę Jumanji).. 🙂 może NIGDY nie wróci”;

– „Well, I just said that Krzysztof is right, close the matter.. and I will add to close, tie it, load it with stones, throw it into the sea (like a Jumanji game).. 🙂 maybe it will NEVER come back”;

 

– „Oprócz żony, dwóch synów i psa spaniela nie ma nikogo. Nikt go nie lubi, wyrzucają go z każdego forum na jakim się pojawi. Nikt nie ma ochoty słuchać jego prostackich zaczepek.. proszę Was ignorujcie go, bo nigdy się nie odczepi”;

– „Apart from a wife, two sons and a spaniel dog, there is no one. Nobody likes him, they kick him out of every forum he appears on. Nobody wants to listen to his boorish taunts.. please, ignore him, because he will never leave us”;

 

– „A ja wnoszę o zablokowanie jego IP dla forum PG”;

– „And I am asking for blocking his IP for the PG forum”;

 

– „A ja sądzę, że MN odreagowuje stresy i jako JK używa sobie na całego.. taki doktor Jekyll i Mr Hyde :).. chociaż… Jekyll to za dużo powiedziane”;

– „And I think that MN relieves stress and as JK he uses it to the fullest.. such doctor Jekyll and Mr Hyde :).. although… Jekyll is too much said”;

 

– „A to jest kolejny 'wspaniały’ felieton […] Jeszcze macie jakieś wątpliwości że JK i MN to dwie różne osoby? przeczytajcie jak tam kłamie i przekręca fakty” [tu rozpowszechnia swoje konfabulowane a sztandarowe kłamstwo o jednej osobie w dwóch postaciach, zaś polska Temida przez dwa lata nie potrafi sobie poradzić ani z kłamczuchą, ani z ustaleniem prawdy].

– „And this is another 'great’ feuilleton […] Do you still have any doubts that JK and MN are two different people? read how he lies and twists the facts” [here the writer lady spreads her confabulated and flagship lie about one person in two forms, and the Polish Themis for two years has been unable to cope with either a liar or establishing the truth].

 

Szanowny Panie Sędzio! Czy trzeba powołać specjalistę* od naszego ojczystego języka, aby uznać, że Pan niedokładnie zapoznał się z „kulturalnymi” tekstami pisarki, albo nie zrozumiał Pan słowa polskiego lub nie miał Pan czasu zapoznać się z dowodami? A może Pan lansuje całkiem inne rozumienie polskich określeń? Przecież już tylko omówienie powyższego wątku dowodzi, że wyrok wydany 18 grudnia 2009 w imieniu III RP nie jest więcej wart, niż jego znikoma wartość w skupie makulatury.

Your Honour! Should a specialist* be appointed in our native language to recognize that you have not read the „glamorous” texts of the writer accurately, or that you did not understand the Polish word or you did not have time to read the evidence? Or maybe you promote a completely different understanding of Polish terms? After all, just the discussion of the above thread proves that the verdict issued on December 18, 2009 on behalf of the Third Republic of Poland is not worth more than its negligible value in a waste paper collection point.

 

Owszem, większą wartość będzie miał dla studentów prawa, którzy będą badać ten przypadek jako jeden z bardziej kuriozalnych w dziedzinie osądzania pozwanych na podstawie niesprawdzonych donosów i niestarannie przeczytanych materiałów dowodowych. Mogą także zainteresować się nim kabareciarze, jeśli zabraknie im politycznych tematów – w końcu ileż to można śmiać się z polityków?

Okazuje się, że facet ma przeprosić pisarkę za to, że opisał jej niegodne i nieuprzejme odzywki, których gdański Sąd jednak nie uznał za takowe! No to Temida istotnie przesadziła z opaską na oczach – nie dostrzegła nieuprzejmości pisarki w jej pisanym słowie? Nic, tylko pogratulować spostrzegawczości…

It turns out that the guy is to apologize to the writer for describing her unworthy and unkind taunts, which the Gdańsk court, however, did not recognize as such! Well, Themis did exaggerate with a blindfold on – did she not see the writer’s discourtesy in her written word? Well, congratulations to the judge for his perceptiveness…

 

Inny fragment wyroku – „Nieprawdziwe jest twierdzenie, aby nakłaniała innych użytkowników do takiego niewłaściwego zachowania”. No to rzućmy drugim okiem na wypowiedzi gdańskiej nauczycielki akademickiej udzielającej się na najdowcipniejszym wątku znanego portalu, pośród wulgarnych (a zabronionych regulaminem!) żarcików:

Another fragment of the judgment – „It is untrue to claim that she induces other users to behave in such inappropriate way”. Well, let’s take a second look at the statements of the Gdańsk academic teacher lady on the most witty thread of a well-known portal, among vulgar (and prohibited by the regulations!) jokes:

 

– „Ale ja się poddaję.. mam dość! Stokroć wolę rozmawiać z młodzieżą niż z takimi dojrzałymi jak Pan. Widzę że się Pan znowu rozkręca..” [większość z owej młodzieży sypała wulgarnymi żartami i takimiż komentarzami, tudzież pogróżkami, zatem pisarka i wychowawczyni młodzieży opowiedziała się po niewłaściwej stronie];

– „But I give up… I’ve had enough! I prefer a hundred times more talking to young people than to mature people like you. I see that you are getting excited again…” [most of these young people told vulgar jokes and such comments, as well as threats, so the writer and the youth educator took the wrong side];

 

– „Panie Moderatorze, byliśmy, jesteśmy i będziemy z Panem. Jak to zabawnie ktoś napisał kto nie z Mieciem tego zmieciem 🙂 Pozdrawiam” [tu zachęta nie tylko do tolerowania wulgarnego słownictwa, z którego słynie to dowcipne forum, ale też wyznanie – „kto nie z Mieciem, tego zmieciem”, a to – w połączeniu z menelskimi pogróżkami skierowanymi do pozwanego – jest jednak sprawą kryminalną; ponadto pisarka składa hołd twórcy chyba najobleśniejszego wątku na NK, zamiast walczyć z nim!];

– „Dear Moderator, we were, are, and will be with you. As someone amusingly wrote who is not with Miecio, we will sweep him away 🙂 Greetings”. [here an encouragement not only to tolerate vulgar vocabulary, for which this witty forum is famous, but also a confession – „whoever is not with Miecio, we will sweep him away”, and this – combined with vulgar threats directed to the defendant – is, however, a criminal matter; moreover, the writer pays homage to the creator of probably the most disgusting thread on NK, instead of fighting against him!]

 

– [na apel innego użytkownika: „Panie Miroslawie… mowilem cos… spadamy, bo nam w koncu w pie..dol spuszcza”], rozbawiona pisarka solidaryzuje się z portalowym kolegą i przekazuje uśmieszki – „:)))))))”;

– [on the appeal of another user: „Mr. Mirosław… I said something… we are falling out of here, because they are finally fuck.ng us”], the amused writer expresses solidarity with her portal colleague and transfers smiles – „:)))))))”;

 

– [na sugestię tego samego kolegi: „Drogi Mirosławie, zgadzam się, powinniśmy poinformować Jego Magnificencje, tu się dzieją rzeczy karygodne!!! Kopię pisma wyślemy też do Kancelarii Premiera. To nasz obowiązek”, podochocona doktorantka UG dodaje (szydząc z przysięgi studenckiej)] – „A ja proponuję jeszcze zacytować przysięgę wojskową, harcerską, ślubowanie pierwszoklasistów.. i w tym kontekście skargi wysłać do jednostek wojskowych, do podstawówek, do drużyn harcerskich.. no i oczywiście kopie do Ministerstwa Oświaty.. i Ministerstwa Obrony”.

– [at the suggestion of the same colleague: „Dear Mirosław, I agree, we should inform His Magnificence, things are wrong here!!! We will also send a copy of the letter to the Chancellery of the Prime Minister. This is our duty”, the cheerful doctoral student of the University of Gdańsk adds (mocking the student oath)] – „And I propose to quote the military and scout oaths, the oath of first–class pupils… and in this context send complaints to military units, primary schools, scout teams.. and of course copies to the Ministry of Education.. and the Ministry of Defense”.

 

Wykładowcy i nauczyciele powinni być na internetowych forach wzorami do naśladowania, zaś w przypadku zamieszczania tekstów obraźliwych oraz wulgarnych, powinni – zgodnie z kodeksem etyki – zwracać dyskutantom uwagę na niestosowne zachowania.

Lecturers and teachers should be role models on Internet forums, and in the case of posting offensive and vulgar texts, they should – in accordance with the code of ethics – draw the participants’ attention to inappropriate behavior.

 

Powódka (nauczycielka akademicka!) nie tylko ani razu nie zareagowała na obrzydliwe teksty jej portalowych współdyskutantów, ale jej komentarze mogły podgrzewać (i podgrzewały!) nieprzyjazne nastroje, które zaowocowały tak obmierzłymi tekstami, że aż wstyd tutaj je zamieszczać. Jeśli jednak ktoś pokusiłby się o przeczytanie całej owej literatury, to mógłby zaniemówić.

The plaintiff (academic teacher!) not only did not even once react to the disgusting texts of her portal co–interviewers, but her comments could heat up (and heated up!) The unfriendly moods, which resulted in such disgusting texts that it is a shame to post them here. If, however, one should read all of this literature, he could become speechless.

 

Czy to są właściwe zachowania? Uprzejme, czy nieuprzejme? Panie Sędzio? W jaki sposób można odebrać wypowiedzi pisarki? Czyż nie jako zachętę do kontynuowania menelskiej twórczości współużytkowników forum?

Is this the correct behavior? Polite or impolite, Your Honour? How can the writer’s statements be understand? Is it not as an incentive to continue the dumb creativity of forum co-users?

 

Mało tego! W kwietniu 2009 doktorantka UG (czyżby nie znała powszechnie stosowanego polskiego słownictwa?) pisze do admina portalu Salon24 – „Chciałabym również oświadczyć że wszystkie teksty jakie mirnal publikuje na mój temat są kłamstwami. Proszę go poprosić aby przedstawił jako dowód na to co pisze na mój temat chociaż jeden wulgarny dowcip lub tekst […]”. Jeszcze większy tupet pisarka wykazała w emajlu do admina portalu AferyPrawa – „Pisze o moich pikantnych dowcipach, których NIGDY nie było”.

What is more! In April 2009, a doctoral student of the University of Gdańsk (did she not know the commonly used Polish vocabulary?) wrote to the admin of Salon24 – „I would also like to declare that all texts that mirnal publishes about me are lies. Please ask him to present at least one vulgar joke or text as proof of what he writes about me […]”. The writer showed even greater audacity in an e–mail to the admin of the AferyPrawa portal – „He writes about my piquant jokes that have NEVER been there”.

 

No to, Panie Sędzio, mamy kolejne starcie prawdy z fikcją kreowaną przez pisarkę – skoro sama doktorantka UG usilnie prosi, zatem spełnijmy jej życzenie. Oto jej żarciki (które – według niej – NIGDY nie były pikantne!):

Well, Your Honour, we have another confrontation between the truth and the fiction created by the writer – since the UG doctoral student herself is asking, let us fulfill her wish. Here are her jokes (which – she said – were NEVER piquant!):

 

– „Zapytaj mamy czy oddałaby się murzynowi za milion dolarów…”. Konkluzja – „Widzisz wirtualnie to mamy 3 miliony dolarów, a realnie mamy dwie dziwki i jednego pedała”;

– „Ask mom if she would give herself to a negro for a million dollars …”. Conclusion – „You see virtually, we have $ 3 million, and in reality we have two whores and one fagot”;

 

– „Kobieta zabawia się z kochankiem, ale nagle słyszy, że jej mąż otwiera zamek w drzwiach. Kobieta w strachu:/ – Boże, cofnij czas o godzinę!/ Słyszy głos z nieba: / – Dobrze, ale kiedyś utoniesz./ Kobieta się zgadza. Mąż się nie dowiedział, a ona ciągle unikała wody./ Pewnego dnia wygrała wycieczkę na Karaiby. Obawiała się, ale postanowiła zaryzykować. Podczas rejsu nastąpił sztorm. Wtedy kobieta przerażona krzyknęła:/ – Boże, chyba nie pozwolisz umrzeć razem ze mną tym 300 niewinnym kobietom!/ – Niewinnym? Od roku was, dziwki, zbierałem w jedno miejsce!”;

– „A woman is playing with her lover, but suddenly she hears her husband opening the lock on the door. Woman in fear:/ – God, turn back the time an one hour!/ She hears a voice from heaven:/ – Good, but someday you will drown./ The woman agrees. The husband did not know about it, and she constantly avoided water. One day she won a trip to the Caribbean. She was afraid but decided to take the risk. There was a storm during the voyage. Then the scared woman shouted:/ – God, you won’t let those 300 innocent women die with me!/ – Innocent? For an one year of you slutes, I’ve been gathering together in one place!”;

 

– „Bogaty w stanie upojenia alkoholowego… *podchmielony*/ Biedny w stanie upojenia alkoholowego… *pijany jak świnia*/[…] Bogaty ze zrobionym manicure… *playboy*/ Biedny ze zrobionym manicure… *pedał*/[…] Bogaty homoseksualista… *gej*/ Biedny homoseksualista… *pieprzony zboczeniec*”;

– „Rich man in a state of intoxication… *beery*/ A poor man in a state of intoxication… *drunk like a skunk*/ […] Rich man with a manicure done… *playboy*/ Poor man with a manicure done… *fagot*/ […] Rich man homosexual… * gay*/ Poor homosexual… *fucking pervert*”;

 

– „Zamiast we wtorek mąż wraca z delegacji w poniedziałek. Wchodzi do sypialni i widzi gołą żoną w łóżku i stojącego obok łóżka gołego, uśmiechniętego faceta w narciarskiej czapeczce na głowie. – Czekaj, ty suko – zwraca się do małżonki – później się policzymy. Potem podchodzi do uśmiechniętego gościa i pyta: – A ty, kto jesteś? Facetowi uśmiech zamiera na ustach i odpowiada: – Jestem totalnie poj****ym kretynem. – Dlaczego? – Pyta zaciekawiony taką samokrytyką mąż. – Bo wczoraj na Stadionie Dziesięciolecia zapłaciłem Ruskiemu 500 złotych za czapkę niewidkę”;

– „Instead of Tuesday, the husband returns from the delegation on Monday. He enters the bedroom and sees his naked wife in bed and a naked, smiling guy with a ski hat on his head standing at the bed. – Wait, you bitch – he says to his wife – we’ll explain that later. Then he comes up to the smiling guest and asks: – And who are you? – „Jasio, pisząc wypracowanie, pyta ojca: – Tato, jak się powinno pisać: Królowa Lodu, czy Królowa Loda?/ – To zależy, synu, czy chcesz żeby była postacią negatywną, czy pozytywną…”;

– „Johnny, writing an essay, asks his father: – Dad, how is it correct: Królowa Lodu (Ice Queen) or Królowa Loda (Blowjob Queen)?/ – It depends, son, if you want her to be a negative or a positive character…”;

 

– „a to pewnie znacie.. 🙂 PRYSZNIC/ Jak kobieta bierze prysznic – Rozbiera sie i sortuje ubranie do koloru i temperatury prania […] Mijajac meza, zaslania szczelnie wszystko/ Jak mezczyzna bierze prysznic/[…] nago leci do lazienki, mijajac zone, macha ptaszkiem i wola 'hu, huu!’/ patrzy w lusterko, oglada ptaszka i drapie sie po dupie/ wchodzi pod prysznic/ jeszcze raz sie drapie, teraz po jajach/ wacha palce, upajajac sie meskim zapachem […]/ myje rowek i jednoczesnie pierdzi/ puszczajac baki, cieszy sie jak to dziwnie pod natryskiem brzmi […]”.

– „and you probably know this..:) SHOWER/ How a woman takes a shower – Undresses and sorts clothes according to the color and temperature of the wash […] Passing her husband, it covers everything tightly/ When a man takes a shower/ […] he flies naked to the bathroom, passing his wife, he waves his bird and says ‘huh huh!’/ he looks in the mirror, looks at the bird and scratches his ass/ enters the shower/ scratches himself again, now his balls/ sniffs his fingers, reveling in the male scent […]/ washes the ditch and at the same time farts/ cut the cheese, enjoys how strange it sounds under a shower […]”.

 

Przy czym, gwoli ścisłości, w swoich artykułach pozwany określił te dowcipy jako pikantne lub przaśne, zaś pisarka przeinaczyła te przymiotniki na „wulgarne” i w takiej formie gdański Sąd przyjął jej słownictwo, czego nie sposób zrozumieć – przecież to przekłamanie, Panie Sędzio! Ale nawet – kwestia granicy pomiędzy przaśnością a wulgaryzmem, to całkiem subiektywna ocena i to, co dla jednego rodaka jest tylko pikantne, dla innego może być już ordynarne.

However, to be precise, in his articles the defendant described these jokes as spicy or unleavened, and the writer transformed these adjectives into „vulgar” and in this form the Gdańsk Court adopted her vocabulary, what is difficult to understand – after all, this is a misrepresentation, Your Honour! But even – the issue of the border between crudeness and vulgarity is quite a subjective assessment and what is only piquant for one compatriot, may be vulgar for another one.

 

Aby postawić kropkę nad i, należy jeszcze wspomnieć dwie wypowiedzi pisarki, zamieszczone na portalu Salon24:

To conclude, two more statements by the writer, posted on the Salon24 portal, should be mentioned:

 

– „by nie było wątpliwości MN=JK=AZ to są te same osoby”

– „to be clear MN = JK = AZ are the same persons”

 

oraz / and

– „Witajcie. Właśnie otrzymałam wiadomość z nk, że konto MN […] i Jacka K. zostały zablokowane do odwołania. Dzisiaj mam spotkanie z moim prawnikiem i omówimy plan działania. Magda”.

– „Hello. I have just received a message from NK portal that the accounts of MN […] and Jacek K. have been blocked until further notice. Today I have an appointment with my lawyer and we will discuss the action plan. Magda”.

 

Panie Sędzio, jak Pan mógł w tak infantylny sposób przeoczyć kolejne kłamstwa pisarki? Dlaczego Pan nie wykazał się zawodową przenikliwością oraz rzetelnością i nie sprawdził, ile pozwany miał kont? A przecież złożył on w Sądzie stosowne oświadczenie – dlaczego Pan mu nie uwierzył? Niech Pan w końcu przyjmie do swej wiadomości, że pozwany na NK miał i ma wyłącznie jedno konto, zatem doktorantka UG wodzi szanowną Temidę za nos i naciska na szalki według własnego uznania, a powinna być przykładnie ukarana przez ową posągową damę polskiego wymiaru sprawiedliwości.

Your Honour, how could you, in such an infantile way, overlook the subsequent lies of the writer? Why didn’t you show professional insight and reliability and check how many accounts the defendant had, Sir? After all, the defendant made an appropriate statement in the Court – why did you not believe him, Sir? Please finally accept that the defendant had and has only one account on NK forum, Sir, so the doctoral student lies to the esteemed Themis at her own discretion, and should be punished by this statuesque lady of the Polish judiciary.

 

Jak długo jeszcze będzie ośmieszany gdański Sąd, który nie może poradzić sobie ze stosunkowo prostą sprawą?

How long will the Gdańsk Court, which cannot deal with a relatively simple matter, be ridiculed?

 

W połowie listopada 2009 Sąd otrzymał wniosek od pozwanego – „Jednocześnie wnoszę o oddalenie powództwa w całej rozciągłości z powodu nieprzekroczenia przez mnie zasad wolności słowa gwarantowanego przez Konstytucję 1997 oraz z powodu dokonania nieetycznych wpisów na NaszaKlasa przez powódkę – publiczne pomówienie mnie o posiadanie 3 kont oraz o sfałszowanie nazwiska we wpisie (komentarzu) na NaszaKlasa i zamieszczenie wulgarnawego seksistowskiego dowcipu”.

In mid-November 2009, the Court received a motion from the defendant – „At the same time, I am requesting that the claim be dismissed in its entirety because I have not exceeded the principles of freedom of speech guaranteed by the Polish Constitution of 1997 and because the plaintiff has made unethical entries on NK forum by the plaintiff – publicly slandering me for having 3 accounts and for falsifying my surname in the entry (comment) on NaszaKlasa and posting a vulgarish sexist joke”.

 

I co na to sędzia gdańskiego Sądu? Nie uznał za stosowne, aby zająć się tymi sprawami! A przecież to z powodu publicznego zniesławienia oraz sfałszowania, ów pozwany – w ramach samoobrony, irytacji i w afekcie – zamieścił szereg artykułów omawiających czyny doktorantki UG! Przeoczenie przez sędziego tego aspektu to podstawowy błąd w uczciwej ocenie czynów obu stron!

And what does a judge of the Gdańsk Court say to that? He did not see fit to go about these matters! And yet it is because of public defamation and falsification that the defendant – as part of self-defense, irritation and affect – published a number of articles discussing the actions of the UG doctoral student! The judge’s omission of this aspect is a fundamental mistake in honestly assessing the actions of both parties!

 

Gdzie bezstronność i chęć poznania powodu sporu? Jeśli ktoś da po łapach sadowemu złodziejowi, a tenże udaje się do Temidy z pozwem, to bezstronność i rzetelność wymaga poznania powodu, dla którego ów zaborca jabłek oberwał od sadownika po kończynach. A cóż czyni nasz niezawisły Sąd? Co zdumiewające, kwestionowana jest rzetelność pozwanego dziennikarza, zaś sędzia gdańskiego Sądu nie grzeszy, niestety, tą roztropną cechą…

Where is the impartiality and willingness to know the reason for the dispute? If someone breaks the orchard thief and the thief goes to Themis with a lawsuit, impartiality and honesty requires knowing the reason why limbs of the apple thief was brocken by the grower. And what does our independent Court do? Astonishingly, the integrity of the defendant journalist is questioned, while the judge of the Gdańsk Court, himself  nfortunately, does not possess this prudent feature…

 

Zajrzyjmy do uzasadnienia wyroku. Sędzia napisał – „Również twierdzenia pozwanego, by powódka prowadziła niegodny tryb życia, nadużywając alkoholu, dążąc do czerpania korzyści w sposób bezprawny, pozostały gołosłowne”. A gdzież to, szanowny Sędzia, doczytał się takich stwierdzeń?!

Let us look at the justification of the verdict. The judge wrote – „Also, the defendant’s claims that the plaintiff led an unworthy lifestyle, abusing alcohol, seeking to obtain benefits unlawfully, were untrue”. And where, honorable Judge, have you read such statements?!

 

A już pęknąć ze śmiechu można czytając – „[…] nie wynika, by istotnie kierowała się ona w stosunku do niego jakiekolwiek obraźliwe stwierdzenia czy opinie, Powódka jedynie w sposób kulturalny starała się odnieść do nieetycznego zachowania się pozwanego w stosunku do niej, jak i pozostałych uczestników forum”, bowiem wcześniej zacytowano owe „kulturalne” wypowiedzi pisarki.

And an amazing laughing stock, here – „[…] it does not appear that she was actually guided by any offensive statements or opinions towards him, the Plaintiff only culturally tried to relate to the defendant’s unethical behavior towards her and other forum participants”, because earlier these „glamorous” statements of the writer were quoted.

 

Śmiech śmiechem, ale ta pani zażyczyła sobie 20 tysięcy zł zadośćuczynienia, zaś pozwany otrzymał pierwszy w życiu wyrok i komornik go nachodzi w miejscu pracy, zatem – w świetle wyroku i uzasadnienia, to przestaje być zabawne – to jest kompromitacja polskiej Temidy!

Laughter with laughter, but this lady demanded 20 thousand zlotys in compensation, and the defendant received the first verdict in his life and the bailiff is attacking him at the workplace, so – in the light of the verdict and the justification, it ceases to be funny – this is a disgrace for the Polish Themis!

 

A przy okazji – Panie Sędzio, proszę wskazać nieetyczne zachowania się pozwanego na portalu NaszaKlasa i to pod groźbą odpowiedzialności karnej! Którą to wypowiedź uznał Pan za nieetyczną? Ponieważ wszystko wskazuje na to, że wypowiedzi nieznanej nikomu osoby (JK), uznał Pan za teksty napisane przez pozwanego (zgodnie z sugestią powódki!), przeto trzeba wyraźnie wyartykułować – które to z tekstów na NK uznał Pan za nieetyczne? I dlaczego nie uznał Pan ani jednej wypowiedzi doktorantki UG za nieetyczną?!

And, by the way, Your Honour, please indicate the defendant’s unethical behavior on the NaszaKlasa portal and under penalty of criminal liability! Which statement did you find unethical, Sir? Since all indications are that the statements of a person unknown to anyone (JK), you considered texts written by the defendant (as suggested by the plaintiff!), it is necessary to clearly articulate – which of the texts on NK did you consider unethical, Sir? And why did you not consider any of the statements of the doctoral student as unethical, Sir?!

 

Jeszcze jeden rodzynek w Pańskim wykonaniu – „Dokonując oceny tych naruszeń [prawa przez pozwanego], Sąd miał w szczególności na względzie sposób rozpowszechniania nieprawdziwych informacji o powódce”. Czyżby obywatel X zniesławiany przez obywatela Y (że ma dodatkowe konta) nie mógł obwieszczać w internecie, że ów Y dopuścił się kłamstwa? Panie Sędzio!?

One more curiosity in your rendition, Sir – „In assessing these violations [of the law by the defendant], the Court was primarily concerned with the manner in which false information about the plaintiff was disseminated”. Is it possible that citizen X defamed by citizen Y (that he has additional accounts) cannot announce on the Internet that this Y lied, Sir!?

 

I nie można opisać przypadku dokonania fałszerstwa przez znaną pisarkę na jeszcze bardziej znanym portalu? To co można, skoro codziennie media donoszą o różnych niegodnych czynach dokonywanych przez naszych rodaków? Przecież ci wszyscy dziennikarze powinni odsiadywać wysokie wyroki albo płacić spore zadośćuczynienia, gdyby wobec nich zastosować kryteria przyjęte przez gdański Sąd wobec pozwanego… Niech Pan ogląda programy typu „Uwaga” (TVN) – w jaki sposób tam rozprawiają się z kłamcami i fałszerzami.

And it can’t describe the case of making a forgery by a famous writer on an even more famous portal? What is therefore possible, since every day the media report on various unworthy deeds committed by our compatriots? After all, all these journalists should serve long sentences or pay substantial compensation if the criteria adopted by the Court in Gdańsk for the defendant were applied to them… Please watch programs like „Attention” (TVN), Sir – how they deal with liars and forgers there.

 

Zresztą w uzasadnieniu wyroku mamy wyjaśnienie dotyczące zignorowania sprawy zniesławiania pozwanego przez powódkę, iż ma on dwa dodatkowe konta – „Warto wskazać, iż ta okoliczność pozostawała poza sferą zainteresowania Sądu w niniejszym postępowaniu”. Sąd zbagatelizował najważniejszy powód sporu – przecież to istny sądowy skandal!

Moreover, in the justification of the verdict we have an explanation regarding the defendant’s disregard for defamation by the plaintiff, that he has two additional accounts – „It is worth pointing out that this circumstance was beyond the scope of the Court’s interest in these proceedings”. The Court downplayed the most important reason for the dispute – it is, after all, a real court scandal!

 

Kolejnym skandalem jest fraza – „Pozwany twierdził również, że powódka dopuściła się w stosunku do niego fałszerstwa, błędnie podając treść jego podpisu na forum. Poza okolicznościami wskazanymi powyżej warto jedynie zwrócić uwagę, że to uchybienie powódki stanowiło jedynie jej omyłkę, do czego sama się przyznała, i choćby z tego względu nie może uzasadniać postawienia jej takiego zarzutu, jaki skierował przeciwko niej pozwany”.

Another scandal is the phrase – “The defendant also claimed that the plaintiff committed a forgery against him by incorrectly entering the content of his signature on the forum. Apart from the circumstances indicated above, it is worth noting that the plaintiff’s misconduct to act was only her mistake, to which she herself admitted, and therefore cannot justify making such a charge against her as the defendant has made against her”.

 

To prawdziwy „logiczny” rarytas sądowy! Doktorantka UG sfałszowała podpis uważając, że pozwany ma konto na inne nazwisko i świadomie a złośliwie (z klawiatury) zmieniła jedno nazwisko (automatycznie generowane przez program cytowania tekstów) na nazwisko pozwanego, zaś Sąd – zamiast przekazać sprawę fałszerstwa do osobnego a surowego rozpatrzenia przez Temidę – uznaje to za… omyłkę? Jaka omyłka, Wysoki Sądzie?! Przecież to świadome i ciągłe działanie, bowiem pisarka do dzisiaj uważa, że pozwany miał owe dodatkowe konta, zatem powinna być ścigana i ukarana przez wymiar sprawiedliwości!

This is a real „logical” court rarity! A doctoral student of the University of Gdańsk forged the signature, believing that the defendant had an account in a different surname and knowingly and maliciously (from the keyboard) changed one surname (automatically generated by the text quoting program) to the surname of the defendant, and the Court – instead of referring the case for a forgery to a separate and strict consideration by Themis – considers it… a mistake? What a mistake, Your Honor?! After all, this is a conscious and continuous action, because the writer still believes that the defendant had these additional accounts, so she should be prosecuted and punished by the judiciary!

 

Gdyby ktoś posiadał narkotyki i przyznałby się do tego, to narkotykowy wątek byłby zignorowany, zaś policjant, który by przekazał Temidzie sprawę narkomana, miałby kłopoty w sądzie, bowiem tenże by uznał, że ponieważ narkoman przyznał się do posiadania, to policjant nie ma prawa ukarać tego przestępcy? Mało tego – policjant zostałby skarcony przez sąd za sporządzenie protokołu, bowiem powinien domyślić się, że po paru miesiącach Temida wspaniałomyślnie uzna, że skoro ów biedak przyznał się do posiadania dragów, to funkcjonariusz powinien przewidzieć stanowisko sądu i nie czepiać się tego obywatela… Przecież pisarka przyznała się dopiero w sądzie, zatem w jaki sposób pozwany mógł przewidzieć, że to uczyni? Natomiast pozwany krytycznie opisał jej czyn parę miesięcy wcześniej, zatem logika Sądu jest doprawdy powalająca!

If someone was in possession of drugs and admitted it, the narcotics thread would be ignored, and the policeman who handed the case of the drug addict over to Themis would be in trouble in court, because the court would decide that since the drug addict admitted to possession, the policeman had no right to punish the offender? What’s more, the policeman would be reprimanded by the court for making the report, because he should have known that after a few months the Themis would magnanimously decide that since the poor fellow had admitted to possessing drugs, the officer should have anticipated the court’s position and not pick on the citizen… After all, the writer only confessed in court, so how could the defendant have anticipated that she would do so? In contrast, the defendant had critically described writer’s act a few months earlier, so the court’s logic is truly mind-blowing!

 

Portal Pardon swój artykuł kończy konstatacją – „Tak kończą niegrzeczne dziewczynki”. Panie Sędzio – a jakie losy powinny być naszej pisarki, która przez dwa lata rozpowszechnia kłamstwa, że facet ma dodatkowe konta na portalu, choć jemu do głowy nawet nie przyszło, aby na jakimkolwiek rejestrowanym portalu mieć więcej niż jedno konto? A do tego sfałszowała podpis, który Pan uznał jako… omyłkę. I dlaczego Pan uznał jej konfabulacje za fakty, zaś oświadczenie pozwanego, że miał i ma jedno konto, zostało przez Pana zignorowane? Bo gdyby jednak Pan wziął pod uwagę to oświadczenie, to losy procesu byłyby całkiem inne – dałby Pan pisarce do zrozumienia, że kłamiąc i fałszując podpis nie ma co liczyć na przychylność Temidy i powinna się wówczas ucieszyć Pańską wspaniałomyślnością, że jej Pan procesu nie wytacza za niegodne zagrywki z polską Temidą.

The Pardon portal ends its article with the statement – „This is how bad girls end up”. Your Honour – what should be the fate of our writer who for two years has been spreading lies that a guy has additional accounts on the portal, although it didn’t even occur to him to have more than one account on any registered portal? And on top of that, she forged a signature, which you acknowledged as… a mistake. And why did you accept her confabulations as facts, while the defendant’s statement that he had and has one account was ignored by you, Sir? Because if you had taken this statement into account, the fate of the trial would have been quite different – you would have let the writer know that by lying and forging her signature she could not count on the favor of the Themis, and she should then be pleased with your generosity in not suing her for her unworthy dealings with the Polish Themis, Sir.
